The Commission found Gordon’s change-in-condition application was time barred pursuant to Code s. 65.2-708. The CAV reversed in a published decision, construing the s. 65.2-708(A) statute of limitations to “run[] anew under each successive award of compensation for a compensable injury…triggered on the last day for which compensation was paid.”
